By visiting our website, creating an account, placing an order, purchasing a product, or otherwise using our Services, you agree to be bound by these Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and any other policies displayed on our website.

Grabana and Sophere products are cosmetic and personal-care products unless expressly stated otherwise.

Individual results vary.

We do not guarantee that any product will:

• Remove or eliminate discoloration;
• Produce identical results for every customer;
• Work within a particular period of time;
• Prevent, diagnose, treat, cure, or eliminate any disease or medical condition; or

Before using a new skincare product, customers should review the ingredients and directions and consider performing an appropriate patch test.

If irritation, discomfort, or an unexpected skin reaction occurs, discontinue use and seek appropriate medical advice when necessary.

4. NO MEDICAL ADVICE

5. INGREDIENT RESPONSIBILITY AND ALLERGIES

Nothing in our Return & Refund Policy or these Terms limits consumer rights that cannot legally be waived.

The Grabana name, Sophere name, logos, product names, packaging designs, website designs, photographs, videos, graphics, written content, advertisements, slogans, and other brand materials are owned by or licensed to Grabana unless otherwise stated.

You may not reproduce, distribute, imitate, republish, modify, sell, exploit, or use our intellectual property for commercial purposes without prior written authorization.

Nothing on our website grants you ownership of any Grabana intellectual property.

14. PROHIBITED USES

You may not use our website or Services to:

• Violate any applicable law;
• Commit fraud;
• Infringe intellectual-property rights;
• Harass or threaten another person;
• Submit false information;
• Introduce malware or harmful code;
• Scrape or harvest information through unauthorized automated means;

WE DO NOT GUARANTEE THAT THE WEBSITE WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE.

EXCEPT FOR WARRANTIES THAT CANNOT LEGALLY BE DISCLAIMED, WE DISCLAIM WARRANTIES ARISING BY STATUTE, COURSE OF DEALING, USAGE OF TRADE, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES TO THE EXTENT THEY MAY LAWFULLY BE DISCLAIMED.

Nothing in these Terms limits warranties or consumer protections that cannot legally be excluded.

17. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRABANA AND ITS OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, AGENTS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE, SERVICES, OR PRODUCTS.

THIS MAY INCLUDE, WHERE PERMITTED BY LAW, LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, DATA, OR OTHER INTANGIBLE LOSSES.

Nothing in these Terms excludes or limits liability where doing so is prohibited by applicable law, including liability that cannot legally be waived or limited.

18. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Grabana and its affiliates, owners, employees, contractors, agents, and service providers from third-party claims, liabilities, damages, or reasonable expenses arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person’s rights.

This provision does not require a consumer to indemnify Grabana for Grabana’s own unlawful conduct where such an obligation would be prohibited by law.

19. GOVERNING LAW

Except where mandatory consumer law provides otherwise, these Terms and transactions with Grabana will be governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Nothing in this provision deprives a consumer of protections that cannot legally be waived under the laws applicable to that consumer.

20. VENUE AND JURISDICTION

To the fullest extent permitted by law, disputes that are not otherwise required to be brought elsewhere by applicable law shall be brought in an appropriate state court located in Brevard County, Florida, or an appropriate federal court having jurisdiction in Florida.

By using the Services, you consent to such jurisdiction and venue to the extent legally permitted.

This provision does not override any mandatory jurisdiction, venue, small-claims, or consumer-protection rights that applicable law does not permit the parties to waive.

21. NO WAIVER

If we do not immediately enforce a provision of these Terms, that does not mean we have waived our right to enforce it later.

22. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will remain in effect.

23. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and other policies incorporated by reference, constitute the agreement governing your use of our Services and purchases from Grabana.

24. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to our business, products, Services, practices, or applicable laws.

Updated Terms will be posted on this page with a revised “Last Updated” date.

Changes will apply prospectively unless applicable law permits otherwise.

Your continued use of the Services following an update constitutes acceptance of the updated Terms to the extent permitted by law.

Customers purchasing from outside the United States may have mandatory rights under the laws of their jurisdiction.

Nothing in these Terms is intended to eliminate rights that cannot legally be waived or restricted.

Customers are responsible for customs duties, import taxes, and similar government charges where applicable unless expressly stated otherwise at checkout.
